Privacy and Confidentiality Policy
Purpose
To ensure all participant information is collected, stored, used, and shared in a way that protects privacy, maintains confidentiality, and complies with the Privacy Act 1988 (Cth), the Australian Privacy Principles (APPs), and the NDIS Practice Standards.
Scope
This policy applies to all staff, contractors, students, and volunteers who collect, access, or manage participant information in the course of providing supports and services.
Policy Statement
We are committed to protecting the privacy and confidentiality of all personal and sensitive information collected from participants, their families, and other stakeholders.
Information is collected only for purposes directly related to service delivery and is managed lawfully, securely, and transparently.
Collection of Information
We collect only the personal information necessary to provide safe, high-quality supports and services. This may include:
- Contact and demographic details
- Health, behavioural, and support information
- Emergency contact details
- Funding and service agreement information
Participants are informed of the purpose of collection and how their information will be used.
Storage and Security
All participant information is securely stored to prevent unauthorised access, use, or disclosure.
- Electronic records are kept in secure, password-protected systems.
- Paper records are stored in locked cabinets within restricted-access areas.
- Access to participant information is limited to authorised personnel whose duties require it.
Access, Correction, and Withdrawal
Participants have the right to:
- Access their personal information
- Request correction of inaccurate or outdated information
- Withdraw or amend consent for information use or sharing
Requests may be made verbally or in writing. We will respond within a reasonable timeframe and in accordance with privacy legislation.
Use and Disclosure of Information
Participant information is used only for the purpose for which it was collected, unless:
- The participant provides consent for another purpose, or
- Disclosure is required or authorised by law, or
- Disclosure is necessary to prevent or lessen a serious threat to life, health, or safety.
Participants are advised that information may be shared without consent only in these limited circumstances.
Information Sharing and Consent
Consent for information sharing is obtained during intake and reviewed as needed.
Participants may nominate individuals or organisations (e.g. medical professionals, family members, support coordinators) with whom information may be shared.
All consent is documented in writing and stored on the participant’s file.
Participant Awareness
At the commencement of service, participants are provided with clear, accessible information explaining:
- How their information is collected, used, and stored
- Their rights to access, correct, and withdraw information
- The limited circumstances where information may be shared without consent
Information is provided in a language, format, and mode of communication suitable for the participant’s needs.
Staff Responsibilities
All staff, contractors, students, and volunteers must:
- Maintain the confidentiality of participant information at all times
- Access information only as required to perform their duties
- Explain privacy rights to participants at intake and review
- Report any actual or suspected breaches of privacy immediately to management
Breach of Privacy
Any breach or suspected breach of privacy will be reported and managed promptly in accordance with our Incident Management and Reporting Policy and relevant privacy legislation.
Review
This policy is reviewed annually, or sooner if required by legislative, regulatory, or organisational changes.
